Da Vinci Robot Lawsuits Increase As System Deployment Becomes More Widespread, States Audet and Partners, LLP


In the little over ten years since the U.S. Food and Drug Administration (FDA) approved use of the da Vinci Surgical System for prostate surgery, the number of da Vinci procedures performed worldwide last year exceeded 450,000*. Recent Study Provides Evidence Anger with Ads is Still Present in Today's Digital Marketplace

An analysis of what consumers really feel about certain types of advertising, commissioned by US-based consumer website InsightsOne, has helped to add further weight to the value of SEO in the modern marketing world.

InsightsOne found that over 90% of internet users questioned reported that they had encountered an annoying advert online.

Further analysis shows the specific types of online advertising deemed most irritating:
  • 79% of respondents said irrelevant pop-up ads angered them.

  • 14% of respondents said they would stop using an advertised product.
  • 13% said they would boycott other products from the same company.

SEO is definitely something that these businesses and agencies should consider in order to bring consumers back to their brand, or to stop them leaving in the first place. What's the incentive? Treating medical errors result in higher profits

Hospitals and healthcare settings should be held accountable for surgical or medical mistakes. This accountability is the ticket to motivating healthcare providers in charge of the health and lives of patients to implement procedures and protocols to reduce malpractice.

However, data from a new study shows just the opposite--some hospitals have no incentive to change their policies and reduce medical errors from occurring because they actually profit from these complications.

The interesting findings of the study

The study was conducted by several entities including the Boston Consulting Group, Harvard School of Medicine and Public Health, and Texas Health Resources and was recently published in the Journal of the American Medical Association.

The study examined over 34,000 medical records of patients who underwent surgery in 2010 at one of 12 hospitals administered by Texas Health Resources, a nonprofit hospital system.

Out of the total number of patients who underwent surgery, over 1800 experienced at least one preventable medical error or complication such as blood clots, pneumonia and infected surgical incisions. Based on the data, these patients required additional hospital stays.

As a result, the average hospital bill for just one patient who experienced medical malpractice was approximately $49,400. (The average cost for patients who underwent surgery without complications was $18,900.)

According to study researchers, medical errors increased profits and provide very little incentive for hospitals to make changes and reduce medical errors. The authors do not suggest that these entities are deliberately causing complications to increase their bottom lines. They simply point out the reasons why hospitals do not take proactive measures to perform better, particularly when these performance enhancements end up costing money.

A spokeswoman for America's Health Insurance Plans says that the current health care system needs drastic modification. We need to diverge from "the perverse incentive of the old fee-for-services system that emphasized quantity over quality, and toward methods of payment that reward better care," she says.

Current incentives to reduce medical errors

Dr. Robert M. Wachter, study researcher and expert in medical errors indicates that measures have in fact been done to increase incentives for hospitals to reduce these errors.

For instance, Medicare no longer reimburses costs for services attributed to medical complications and even reduces the amount of reimbursement for hospitals that have high readmittance rates or receive poor satisfaction survey ratings. Unfortunately, Medicare rarely refuses to reimburse hospitals for avoidable medical errors.

Wachter says, however, that more is definitely needed. Until a concrete plan is in place to provide incentives for all hospitals to choose quality instead of quantity, it's likely medical errors will continue.

Study finds surgical "never events" happen an average of 80 times a week

Some medical mistakes are called "never events" because they cause so much unnecessary harm to patients and they are so preventable that they should never happen. Yet these dangerous medical errors continue to occur disturbingly often -- even after protocols were implemented to check against them. Patients who have been harmed by medical malpractice such as a surgical error should contact a lawyer to discuss how they may seek compensation to help them pay for medical bills and other expenses resulting from the error.

Surgical never events

Surgical never events are serious and avoidable medical mistakes that include wrong-patient, wrong-site and wrong-procedure surgeries. In addition to instances where a doctor operates on the wrong leg, for example, never events also include cases where surgical equipment is mistakenly left in a patient and not discovered until after the surgery is complete.

A study recently published in the journal Surgery examined a federal record of medical liability settlements and judgments for surgical errors and found surprising results. Between 1990 and 2010, nearly 10,000 claims were made for surgical errors, which is an average of about 4,000 surgical errors per year or approximately 80 never events each week.

The study said that, in most cases, the harm caused to the patient was temporary, although a third of the cases involved permanent injuries. In addition, about half of the surgical errors involved surgery on the wrong patient altogether, in the wrong location on the patient or with the wrong surgical procedure. The other half were claims for never events where surgical equipment was left behind in a patient, such as sponges that are used to soak up blood and other fluids during surgery but that are difficult to see in X-rays taken before the wounds are closed.

Further, the study found that these errors were not more likely to occur with new doctors emerging from residency or among older doctors nearing retirement. Instead, most of the mistakes -- 36 percent -- were committed by doctors age 40 to 49 years old. Thirty percent occurred among doctors between age 50 and 59, and less than 15 percent were committed by doctors age 60 and older.

Mistakes in the operating room

In 2004, the Universal Protocol was developed to build in mandatory safety checks against never events like wrong-site surgery and was implemented among members of a large medical accreditation organization called the Joint Commission. The Universal Protocol still does not prevent all surgical errors, though, with so many opportunities for mistake in the operating room and so many never events still happening. DALLAS, April 30, 2013 More than a third of stroke patients dont get to the hospital by ambulance, even though thats the fastest way to get there, according to new research inCirculation: Cardiovascular Quality and Outcomes,an American Heart Association journal.

Researchers studied records on more than 204,000 stroke patients arriving at emergency rooms at 1,563 hospitals participating in the American Heart

Association/American Stroke Associations Get With The Guidelines-Stroke quality improvement program in 2003-10.

Emergency medical services (EMS) transported 63.7 percent of the patients, with the rest arriving in various other ways, researchers said.

During a stoke emergency, quick treatment is critical. EMS transported 79 percent of those who got to the hospital within two hours of the start of their symptoms. That resulted in earlier arrival, quicker evaluation and faster treatment, said the researchers who found:

EMS are able to give the hospital a heads up, and that grabs the attention of the emergency room staff to be ready to act as soon as the patient arrives, said Jeffrey L. Saver, M.D., senior author of the study and director of the UCLA Comprehensive Stroke Center in Los Angeles, Calif. The ambulance crew also knows which hospitals in the area have qualified stroke centers. Patients dont lose time going to one hospital only to be referred to another that can provide more advanced care if needed, whether thats drugs to bust up the clot or device procedures to remove it.

Minorities and rural residents were less likely to call for EMS at the signs of a stroke, researchers found.

A number of factors can fuel the reluctance to call 9-1-1, said James Ekundayo, M.D., Dr.P.H., lead author of the study and assistant professor in the Department of Family and Community Medicine at Meharry Medical College in Nashville, Tenn. People may not recognize symptoms and may delay seeking medical care or call their doctor instead.

We hear people say they just didnt want to be a bother, but many times there could have been a better outcome if EMS had been called.

About 795,000 Americans experience a new or recurrent stroke each year a stroke every 40 seconds or a related death every four minutes.

Boosting public awareness efforts and education is critical to improving stroke outcomes in the short- and long-term, researchers said.

From coast to coast and an ocean away some of the biggest trees in the nation have new bragging rights today, as American Forests unveiled the spring 2013 update to its "National Register of Big Trees." More than 40 new trees were declared the biggest of their species today with the release of the National Register, which contains a total of almost 780 national champion and co-champion trees. Highlights include:
  • Oregon has 26 national champion trees, with newcomers including a ponderosa pine and blue-myrtle blueblossom.
  • Two co-champion palm coconut trees in Hawaii have been dethroned by a bigger palm also located in Hawaii.
  • Texas moves into second place, overtaking Arizona, with 90 national champions, including co-champion anacua trees, nutmeg hickory, delta post oak and mescalbean sophora, and Florida remains the state with the most national champions.
  • Kentucky has a new co-champion American basswood. The tree is located next to Henry Clay's tomb in historic Lexington Cemetery.
  • Unfortunately, six of South Carolinas national champion trees have been dethroned due to the 10-year rule. Trees that have not been re-measured in the last 10 years are removed from the register, as the trees need to be checked to confirm their health and condition.

American Forests developed the toolkit to provide guidance and instruction on how to save and protect trees locally. Teen drivers are at risk

Floridians with teenagers are right to be concerned when their children get behind the wheel. Motor vehicle accidents are the leading cause of death for teens in the United States, according to the Centers for Disease Control and Prevention. Statistics reported by the CDC indicate that about 3,000 teenagers died on America's roads in 2009.

The problem with teen drivers

The CDC says that drivers aged 16 to 24 have the highest accident rate. These young drivers have about 150 accidents per 1,000 drivers, compared to less than 80 accidents per 1,000 for all other age groups. And when considering number of crashes based on miles driven, young drivers are four times more likely to have an accident than other drivers.

Teens are especially vulnerable to motor vehicle accidents for a number of reasons. These include:
- Distracted driving, due to using cell phones, eating or adjusting the radio
- Driving with other teens in the car, which increases the risk of an accident more and more with each additional teenaged passenger
- Inexperience, proven by the fact that teens have the highest accident rate during their first year as licensed drivers

Failing to wear seat belts contributes to death and injury for all age groups, and teenaged drivers unfortunately are the group least likely to comply with seat belt laws. Another factor that increases the dangers for all drivers is nighttime driving, with teens at the highest risk for fatal accidents at night.

A solution from Florida sheriffs

In 2007 the Florida Sheriffs Association introduced its Teen Driver Challenge program all over the state, following a successful pilot program in Leon County. According to the FSA, more than 35 Florida counties are on board with TDC.

The curriculum for TDC was developed by a team of driving experts certified as emergency vehicle operators. The course includes 12 hours of training, over two days, at no cost to the 15- to 19-year-old students enrolled. Students take a pre-test before beginning the course and a post-test upon completion, as a part of the four-hour classroom component of TDC. The remaining eight hours are spent on a driving course.

Every student who participates must have valid driver's license or learner's permit and bring a vehicle that they usually drive for the behind-the-wheel part of the course, with proof of insurance. Those who have a learner's permit must bring a licensed driver to accompany them on the driving range.

With a recommended five-to-one student-teacher ratio, teens receive plenty of individual attention. The classroom segment covers issues like distracted driving, seatbelt use and traffic laws. The driving range is often located at a law enforcement training facility, but trainers can use any large empty open area, and some even use airport runways. Young drivers practice safe braking, cornering and other skills.

Teens who complete the course receive a certificate they can take to their car insurance companies to be considered for reduced rates. The eight hours on the driving range can also be included in the 50-hour requirement for Florida's Graduated Driver's License Program.

Accidents do continue to happen, and anyone who is injured as a result of someone's negligence should look into seeking compensation. A personal injury attorney can file a lawsuit seeking payment of medical expenses and lost wages, along with money for pain and suffering. Relatives of a person who dies in a crash can sue for wrongful death damages.

"Obviously, everyone wants to look fantastic on their wedding day," says Dr. Castellano, a breast augmentation specialist in Tampa. "After all, the photos and videos are set to become future family heirlooms. So it's only natural to want your big day to be as perfect as possible."

According to a survey taken on The Knot, a popular wedding planning site, brides are taking more time to plan their weddings than ever before, often starting over 12 months before the wedding date. And, although summer is often thought of as high wedding season, The Knot also reports that many brides are choosing to get married in the fall.

"The spring months are an ideal time for cosmetic procedures, both for people who want a few medspa treatments before their summer wedding and for people who are looking for a more extensive surgical procedure in advance of their fall nuptials," adds Dr. Castellano. "You want to build in a healthy buffer to allow for recovery time before the big day."

For women and men with more time on the planning end, cosmetic surgeries like rhinoplasty, breast augmentation, or liposuction can be performed months ahead of time. Couples that are closer to their wedding date may opt instead for minimally invasive procedures that require little to no recovery time, such as BOTOX Cosmetic injectables or injectable fillers. Chemical peels, laser resurfacing and microdermabrasion are other minimally invasive options that can smooth and even out skin tone and minimize facial scarring or irregularities in time for this special occasion.

"I don't think putting extra effort toward your appearance is anything new when it comes to your wedding day," adds Dr. Castellano. "It's just that things like liposuction are now getting included in the list of other beauty preparations."

The nickname "Bridalplasty" has been coined in reference to brides who opt for plastic surgery before their weddings, and the practice is becoming increasingly common. Body contouring procedures such as liposuction can help women look ravishing in their wedding dress and men fit perfectly into their tux.

"Liposuction can definitely help fine-tune your figure before you start dress shopping," notes Dr. Castellano. The most recent statistics from the American Society for Aesthetic Plastic Surgery indicate that facelifts were the most popular procedure for patients 65 and older in 2012, a trend that plastic surgeon Dr. John T. Alexander II (http://www.alexandersurgery.com) has seen echoed in his own San Diego practice as well.

"People are living longer," explains Dr. Alexander, a facelift specialist in the La Jolla area. "And they're staying active longer into their retirement years, too. It's only natural that people want their reflection to match their energy level, regardless of their age."

Patients over the age of 50 accounted for 37 percent of all cosmetic procedures performed in 2012, with the over 65 age group accounting for eight percent of that total. Facelift surgeries among 51 to 64 year olds accounted for 60.2 percent of the total facelifts performed in 2012 and were the second most popular procedure in that age group for the year. Patients over 65 accounted for an additional 24.2 percent of facelifts performed last year. The number of facelift surgeries performed last year saw a 2.5 percent increase overall from the previous year, and a 20 percent increase since 1997.

"I think by the time you reach a certain stage in life, you just think 'Well, why not?'" says Dr. Alexander, who treats men and women of all ages at his San Diego cosmetic surgery practice. "Many older Americans have more comfortable lifestyles and a more comfortable retirement income than ever before. Why not invest those resources back into themselves?"

Cosmetic procedures on the whole have also increased in recent years. From 2011 to 2012, there was a three percent increase in the total number of cosmetic surgical procedures. Between 1997 and 2012, an 80 percent increase occurred. For nonsurgical procedures, the numbers are even more impressive: minimally invasive treatments like laser procedures, injectables and skin resurfacing have enjoyed a surge of 500 percent since 1997. Total nonsurgical procedures have increased by 461 percent in that time; the total number of cosmetic procedures, both surgical and nonsurgical, has increased 250 percent.

Older adults accounted for nearly half of the total nonsurgical treatments performed in 2012. Procedures such as injectable fillers, BOTOX Cosmetic and surface treatments like laser resurfacing and chemical peels are popular options in this age group.

"Aging adults are taking a tiered approach toward cosmetic treatments," adds Dr. Alexander. "They begin with less invasive procedures at the earliest signs of aging, then gradually progressing toward surgeries such as facelifts and eyelid surgery as they near or enter retirement. I'm encouraged to see an increasing number of people making a point of looking good and feeling good well into their retirement years."

Airbag defect leads to manufacturer recalls

A defective airbag part has lead to a global recall of more than three million vehicles manufactured by Honda, Toyota, Nissan and General Motors. Additional automakers are expected to announce similar recalls soon. The recalls affect vehicles manufactured between 2000 and 2004.

Faulty canisters may explode

At issue in the recalls are small, propellant filled canisters manufactured by the Takata Corporation of Japan. These canisters are installed in millions of vehicles all over the world and are essential components in airbag systems.

When a car accident occurs, propellant housed in a small metal canister ignites, filling the airbag with gas and protecting the passenger. The canister is perforated with small holes designed to allow the gas to escape. When operating properly, the propellant burns at a specific rate. In the faulty canisters, however, the propellant burns too quickly and the holes in the canister are not big enough to allow the gas to escape. When this happens, the canister can explode and send shrapnel into a vehicle's passenger area.

So far, there have been no reports of inadvertent ignition and explosion in vehicles with the faulty canisters. Instead, all reported problems have occurred in crashes.

Multiple automakers issue recalls

Honda has recalled 1.1 million cars, including 2001-2003 model Civics, 2002-2003 model CR-Vs and 2002 model Odyssey minivans. Though it has recalled millions of vehicles world-wide, Toyota recalled approximately 510,000 vehicles in the U.S. The models affected include the Corolla, Matrix and Lexus SC 430. Toyota believes that only a small number of their vehicles have the defective modules, but they must test all listed models to make sure. General Motors recalled approximately 55,000 2003 model year Pontiac Vibes for testing. Ford has not yet announced any recalls, but the company is currently researching whether it used any of the defective Takata components.

Automakers are likely to act quickly out of an abundance of caution, not only to prevent potential injuries to consumers, but also to avoid fines by U.S. regulators. In 2010, Toyota paid a total of $48.8 million in civil penalties after the company failed to notify the U.S. Department of Transportation of accelerator safety issues within the time period required by law.

Defective products are a safety hazard

Unfortunately, in their effort to increase sales, manufacturers sometimes distribute products that are defective, either due to poor design or faulty manufacturing techniques. If a person is hurt because of a negligently designed or manufactured product, the manufacturer may be liable for his injuries.

New Mercator Report: Mobile and Tablet Banking - A Catalyst for Change

Mobile devices are changing the way consumers manage their lives, including their financial lives. The rapid proliferation of Internet-accessible mobile devices (combined with broader availability and popularity of mobile banking apps) is driving mobile banking adoption. According to CustomerMonitor Survey Series data, by October 2012 more mobile banking customers were using apps from their financial institutions than from the mobile Web to conduct mobile banking activities.

Mobile and Tablet Banking: A Catalyst for Change is the sixth in a series of eight consumer survey reports based on Mercator Advisory Groups CustomerMonitor Survey Series. The foundation of this study is data obtained during a national sample of 1,008 online consumer survey responses completed between October 23 and November 2, 2012. The study examines market dynamics including: changes in mobile and tablet usage, methods and frequency of communication with financial institutions, various banking activities performed by mobile device, and mobile bankings impact on branch visitation.

Mobile banking offers a new level of convenience, engaging customers with more frequent contact at a lower cost. Yet, financial institutions need to make it easier, more secure and responsive to bank by mobile, stated Karen Augustine, manager of CustomerMonitor Survey Series at Mercator Advisory Group and the author of the report.
